Petition Process

Petition Process

  • 01. Introduction as an Agenda
    • Introduced as “Petition ooo".
  • 02. Explanation (Report on Deliberation)
    • Petitions deliberated by the Special Committee on Deliberation of Petitions or standing committees are reported.
    • Petitions directly deliberated by the general meeting are introduced by the relevant committee members and heard (The general meeting may request for the explanation of the purpose of the petitions).
  • 03. Q&A
    • Q&A is generally carried out with the mayor or the department chief/team chief in charge of petition processing.
    • Department chief/team chief may be summoned by the general meeting or voluntarily attend the meeting.
    • The council members introducing petitions may be questioned.
  • 04. Discussion (Voting)
    • Request a trial for a fine to the competent court
  • Opinions of the mayor or relevant officials shall be heard for petitions that require budget-related actions

  • 05. Voting and Decision
    • Petitions deliberated by the Special Committee on Deliberation of Petitions or standing committees are reported.
    • Petitions directly deliberated by the general meeting are introduced by the relevant committee members and heard (The general meeting may request for the explanation of the purpose of the petitions).
  • 06. Transferred to the Mayor
    • Petitions are not passed but the opinions on the petitions are adopted.
    • For the petitions directly deliberated by the general meeting, the council member wishing to introduce a petition shall submit a written letter of opinion and the petition deliberates the petition (only parts of the petition may be accepted)

      ※ The letter of opinion for petitions deliberated by committees may be adopted as it is or amended by the general meeting.

  • 07. Reporting Results
    • [Original Petition] and the [Letter of Opinion] adopted by the general meeting are transferred.

Submitting Petitions

  • A petition must be submitted in a written document attaching a council member’s letter of opinion for introducing the petition.
  • A petition must include the name (name of the company and company representative), address and contact information of the petitioner and be signed by the petitioner.
  • The council member introducing the petition must sign the petition and the letter of opinion for introducing the petition.
  • The petition must include what the petition is about and what action the petitioner wishes the Council to take in detail.
  • The petitioner must attach a copy of the resident registration confirming their address or place of residence. ;
  • For joint petitions with multiple petitioners, the representative must be clarified and the original copy of the signature sheet must be attached to the petition.
  • Other documentary proofs may be attached as well (floor plans, photos, etc.)
Subjects of Petitions
  • Demands for remedies“ Demands for correction, punishment or disciplinary actions against unlawful public officials
  • Demands for enactment, revision or abolition of laws
  • Matters related to public systems, facility operations

Receipt of Petitions

  • Receipt of petition means that a petition submitted has been officially received.
  • Petitions are received after checking their requirements.
  • Petitions are registered on petition records.
Request for Supplementation of Petition
  • Petitioner shall be requested to supplement their petition when the requirements are not fully met
  • Requirements: Council member’s letter of opinion for introducing the petition, clear description of what the petition is about and what petition wishes, address, name and signature of the petitioner.
  • Supplementation Period: 15 days

Acceptance of Petitions

  • Acceptance of petition is a quasi-legislative act of acknowledging that the petition submitted is valid and that it meets formal and content requirements.
  • Petitions shall be accepted when they meet formal requirements and do not contain content that is not accepted.
  • Petitions Not Accepted
  • Matters interfering with ongoing trials
  • Matters violating any law
  • Matters defaming the head of state and government organizations
  • Duplicate Petitions: If two or more petitions submitted to the same organization were submitted for different reasons but if they are containing the same demands, the petition submitted later shall not be accepted for processing.

※ Penalties: Petitions containing false information intended to slander others

Notification of Non-Acceptance
  • When the submitted petitions cannot be accepted, the reasons for non-acceptance shall be notified to the petitioner(s) and the council member wishing to introduce the petition.
Objections
  • When the petitions are not accepted on grounds of duplicate petition, the petitioner may file an object through the council member wishing to introduce the petition within 15 days after receipt of the non-acceptance notice.
  • The chair of the council shall accept the petition for processing when he or she deems the objection reasonable.
Petition Withdrawal
  • When petitioners wish to withdraw their petition, they should specify the reasons for withdrawal on the withdrawal application signed by the petitioner and the council member concerned and submit the application to the chair of the council.
  • Approval of committees or the plenary is required to withdraw the petitions already submitted to the plenary or committees.
